A Georgia Attorney General press release says Fulton County Superior Court Judge Paige Whitaker granted summary judgment to the State on July 8, 2026, after a challenge to the law creating the Prosecuting Attorneys Qualifications Commission.
The Office of the Georgia Attorney General said July 8 that Attorney General Chris Carr issued a statement after a court decision upholding SB 92, the law the release says created the Prosecuting Attorneys Qualifications Commission, or PAQC.
According to the press release, Fulton County Superior Court Judge Paige Whitaker granted summary judgment to the State on July 8, 2026.
The release states that after SB 92 was passed and signed into law in 2023, the Stone Mountain Judicial Circuit District Attorney, the Augusta Judicial Circuit District Attorney and others filed suit in an attempt to block the PAQC’s operations.
The attorney general’s office said it defended the law in the case.
In the statement included in the release, Carr said, "We commend Judge Whitaker’s strong decision, and we’re proud to have defended the PAQC’s efforts," and argued that prosecutors who ignore the law should face accountability.
